With an increasing number of criminal prosecutions targeting speech online, and the right to protest and assemble, this presentation will cover the fundamentals of First Amendment defenses for our indigent clients.  We will discuss the current constitutional framework, the difference between as-applied and facial challenges, and practical ideas for litigating online threat cases and prosecutions under federal and state rioting statutes, including pretrial motions, jury instructions, and appeals.
